Terms of Service

These Terms of Service ("Terms") govern your access to and use of shop.saturate.co (the "Site") and your purchase of products from Saturate, operated by The Saturation Company ("Saturate," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

1. About Us
Saturate is a U.S.-based company that sources, tests, and sells hyperbaric oxygen chambers for home use. You can reach us anytime at hi@saturate.co or (747) 255-1173, Monday–Friday, 9am–5pm PST. We are based in Los Angeles, California, USA.

2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to purchase from us. By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. Products as General Wellness Devices
Saturate chambers are sold as general wellness products only. They are not FDA-cleared medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Any reference on the Site to research, studies, or clinical pressures is provided for informational purposes only and does not imply that our products replicate the outcomes of those studies. You should consult a physician before use, particularly if you have any medical condition. You are responsible for using each chamber in accordance with the operating instructions and safety guidance provided.

4. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Please notify us promptly of any unauthorized use.

5. Pricing, Product Information & Availability
We work to ensure that product descriptions, specifications, images, and pricing on the Site are accurate. However, errors may occur. We reserve the right to correct any errors and to update product information, pricing, and availability at any time without prior notice. If a product's correct price differs from the price displayed, we will contact you before processing your order and give you the option to proceed at the correct price or cancel. Prices are listed in U.S. dollars.

6. Orders & Acceptance
Your submission of an order is an offer to purchase. All orders are subject to acceptance by us, and we may decline or cancel an order at our discretion (for example, due to product unavailability, suspected fraud, or an error in pricing or product information). If we cancel an order you have already paid for, we will issue a full refund.

7. Returns, Cancellations & Refunds
Returns, cancellations, and refunds are governed by our Return & Refund Policy at shop.saturate.co/policies/refund-policy, which is incorporated into these Terms by reference. In summary: because each chamber is allocated and prepared to order, you may cancel for a full refund within 48 hours of placing your order, and for a refund (less any non-recoverable payment-processing fees) any time before your chamber ships. After shipment, chambers are not eligible for general return or exchange, but are covered by the damage, defect, and warranty terms in our Return & Refund Policy. If you have any problem with your order, please contact us at hi@saturate.co or (747) 255-1173 and we will work with you in good faith to reach a fair resolution.

8. Payment & Billing Disputes
By placing an order, you authorize us to charge your selected payment method for the total order amount, including any applicable taxes and optional services. If you believe there is an error or problem with a charge, please contact us first at hi@saturate.co or (747) 255-1173 so we can review and resolve it directly. We are committed to addressing billing concerns promptly and in good faith, and we ask that you give us the opportunity to resolve any issue before escalating a dispute.

9. Financing
Financing, where offered, is provided by third-party lenders (such as Affirm) under their own terms and approval criteria. Saturate is not the lender and is not a party to your financing agreement. If you cancel an eligible order within the cancellation window described in our Return & Refund Policy, we will process the corresponding refund to your lender, after which your balance is adjusted according to your lender's terms. Any ongoing rights or obligations under a financing agreement are governed solely by the agreement between you and your lender.

10. Shipping & Delivery
Shipping and delivery are governed by our Shipping Policy at shop.saturate.co/policies/shipping-policy. Chambers are large freight items; please review that policy for delivery methods, scheduling, and the requirement to inspect your shipment on arrival. Title and risk of loss pass to you upon delivery by the carrier.

11. Warranty
Each Saturate chamber includes a 1-year warranty covering parts and manufacturing defects, as described in our Return & Refund Policy and Warranty page. The warranty does not cover damage from misuse, improper setup, failure to follow operating instructions, normal wear and tear, or unauthorized modifications or repairs. Except for this limited warranty, and to the fullest extent permitted by law, products are provided "as is" without other warranties of any kind, express or implied. Nothing in these Terms limits any non-waivable warranty or consumer rights you may have under applicable law.

12. Intellectual Property
All content on the Site — including text, graphics, logos, images, and the "Saturate" and "The Saturation Company" names and marks — is owned by or licensed to us and is protected by intellectual-property laws. You may not copy, reproduce, or use our content or marks without our prior written permission.

13. Acceptable Use
You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorized access to our systems, to interfere with the Site's operation, or to misuse the Site in any way that could harm Saturate or other users.

14. Third-Party Links & Services
The Site may link to or rely on third-party websites and services (such as payment processors and lenders). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their terms.

15. Disclaimers
To the fullest extent permitted by law, the Site and our products are provided "as is" and "as available." We do not warrant that the Site will be uninterrupted or error-free. The general wellness disclaimer in Section 3 applies to all products and all content on the Site.

16. Limitation of Liability
To the fullest extent permitted by law, Saturate and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use or misuse of a chamber. To the fullest extent permitted by law, our total liability for any claim relating to a product or these Terms will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

17. Indemnification
You agree to indemnify and hold Saturate harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of a product, to the extent permitted by law.

18. Dispute Resolution & Arbitration
We hope to resolve any concern directly, so please contact us first at hi@saturate.co or (747) 255-1173 — most issues can be resolved without a formal dispute.

Any dispute or claim arising out of or relating to these Terms or your purchase that cannot be resolved informally will be settled by binding individual arbitration administered by a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies. Arbitration will be conducted on an individual basis; claims may not be brought as a plaintiff or class member in any class or representative proceeding.

Your right to opt out. You may opt out of this arbitration provision within 30 days of your purchase by emailing hi@saturate.co with your name and order number. Opting out will not affect any other part of these Terms. This section does not prevent either party from seeking relief in small-claims court for qualifying claims, and nothing in these Terms limits any rights you may have under applicable consumer-protection law.

19. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except where preempted by applicable federal law (including the Federal Arbitration Act for Section 18).

20. Changes to These Terms
We may update these Terms from time to time. The "Effective date" above reflects the most recent revision. Changes apply to orders placed after the updated Terms are posted; your continued use of the Site after changes are posted constitutes acceptance.

21. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.

22. Entire Agreement
These Terms, together with our Return & Refund Policy, Shipping Policy, Privacy Policy, and any other policies referenced here, constitute the entire agreement between you and Saturate regarding your use of the Site and your purchases.
